Can dr death receive fair trial

Finally, the Supreme Court held that anything occurring in open court is fair game for the press to report. Stuart , U. In another highly publicized murder case, a Virginia judge tried a different approach to stop the publicity. At the request of the defendant, he closed the trial to the press and public. In declaring this tactic unconstitutional, the Supreme Court ruled that the press and public have a First Amendment right to attend criminal trials except in rare cases.

Virginia , U. So if trials can only rarely be closed, what about pretrial hearings where much evidence is discussed? Some of this evidence may be very prejudicial to the defendant and not even be admissible at the trial itself. In a California case in which the defendant was accused of administering a lethal drug overdose to 12 hospital patients, the judge closed the preliminary hearing.

But again the Supreme Court ruled that the press and public have a right under the First Amendment to attend and read transcripts of pretrial hearings except under strictly defined conditions. Superior Court , U. In summary, U. When jurors are exposed to news reports, they may prejudge a case. In highly publicized cases, judges can use various remedies to make sure the defendant gets an impartial jury.

To assure fair trials, some nations, like Great Britain, prohibit most news stories about pending or ongoing criminal trials. In the United States, the First Amendment prohibits press censorship.

In this activity, students role-play judges deciding what the best remedy is to reduce the effect of high publicity in three criminal cases. Break the class into small groups. Each group will role-play judges. The judges should discuss each of the three cases below and decide on the single best remedy for each case.

The remedies are; change of venue, continuance, no-comment rule, voir dire, instructions, or sequestering. After the groups have decided on each case, discuss each case in turn with each group of judges reporting back. Mary Smith. Smith, a world-famous singer who each year puts on a major concert to raise money for a charity, is charged with stealing large sums of money from the charity.

The police and prosecution have not spoken with the press, but since Smith is a superstar, the press has spent a lot of time digging up information from other sources. The story has run in all the media throughout the country, and the trial promises to be a major media event.

These four are charged with murdering 20 people in a cold-blooded shooting spree in a park. The viciousness of the crime has attracted nationwide media attention. Various stories have appeared in the media claiming that Roger Anthony manipulated the others into committing the crime. Although no source is given for these stories, many believe one of the attorneys is the source.

Peter Jones. Jones, a stranger to the small town of Canberry, is charged with robbing and murdering a convenience store clerk. Because of the upcoming trial, the Canberry prosecutor and police have not talked with the press. But a prosecutor from another state, where Jones is wanted for a similar crime, has spoken extensively with the media.

This story has played prominently in the local media. Alumni Volunteers The Boardroom Alumni. Two of the twelve jurors appointed were asked to come back while the other ten had been tested and deemed to be unfair. This has resulted in the jurors undergoing a four stage selection process to be sure that they have no previously existing bias attitudes towards the particular defendant, which would impair their ability to judge the case fairly.

Stage two involves the prospective jurors querying whether they are fit to be a juror for the particular case. Stage three consists of a questionnaire to find out how the prospective jurors had heard of Patel and what they know about him already, among other related topics. Stage four requires the jurors to answer questions which are provided by both the prosecution and defence legal counsel. This is to occur in open court to screen any impartiality.

I think this is a very reasonable course of action. This is because, the case is quite controversial and would require the jurors to determine whether or not Patel is guilty of manslaughter of a number of people. This makes me feel that in cases like this particular one, a majority jury system is needed rather than a unanimous.

This is because, a unanimous jury system, more so than a majority, requires more time and discussion. However, in a majority, a vote needs to take place and the verdict which has the majority will come to order. This is because, if the wrong people were chosen to be a juror for the Jayant Patel case they could take the time which is needed, more so in a unanimous jury to influence the other jurors.

However, because they had undergone so much scrutiny, then it is unlikely that many jurors, who possess this attitude, would be selected. This would result in the rest of the even-minded jury members, we hope, outnumbering the biased jurors and resulting in the correct outcome, which would not, in my opinion, happen in a unanimous jury system.

This strenuous test ensured that the jurors did not have any pre-existing bias that might influence their ability to judge the case fairly. Once the fourth stage of the screening was reached only two jurors remained suitable for the role of jury in this challenging case.

The other 13 were dismissed, causing much controversy and the court case to be delayed. I would suggest that a unanimous conclusion should be made. Through a unanimous verdict, the evidence will be deliberated in great depth in comparison to a majority vote which may not be discussed in as greater detail. Although some may believe that the selection process was unreasonable, I believe that for this specific case it was necessary. For other cases, this type of screening may not be required.

He is currently defending manslaughter charges after Mervyn Morris, 75 year old man passed away after a surgery was performed on him in The Jury selected for the case were deemed bias with eight of them being dismissed from the courts due to bias- Only two of them currently remain. It is believed that the media speculation played a vital part in the destruction of this case. All of these factors can play a role in Judge convicting a man unfairly.

If this had been a majority voting jury the case could be unfairly ruled in the first few minutes of the discussion because if there is only one vote there is no real chance of providing the details. I believe a unanimous voting system has made the case a lot fairer because not all of the current Jurors are subject to bias allegations. Dr Jayant Patel was convicted in June on 3 counts of manslaughter of patients while working at the Bundaberg Hospital.

He was sentenced to 7 years imprisonment. In August the full bench of the Australian High Court quashed all convictions and a retrial was ordered because they deemed some of the evidence to be irrelevant to the case. The initial court case was widely reported in the media so I believe it was a reasonable decision for the jurors to dismiss themselves from the jury if they had been exposed to previous publicity about the case.

A unanimous decision requires everyone to discuss and analyse all the facts in depth in order to reach a fair outcome and is more likely to leave no reasonable doubt. Jayant Patel is on tiral for a very serious crime, the crime of manslaughter and for the first time in Queensland history the selected jurors have had to undergo a 4 step selection process before being chosen for the case.

They were being tested to make sure none of these jurors had any previous bias towards the accused and that they would decide on his fate based on the evidence provided to them in court, eight jurors were deemed unacceptable for this job. I do think that it is appropriate that jurors be dissmissed if they are not willing to give the accused the benefit of the doubt and are able to reassess all of the evidence and not make their decison based on what they have heard previously.

Dr Jayant Patel, an Indian born American doctor, was convicted for the murder of three of his patients in He worked in Bundaberg Base Hospital for two years, without valid medical qualifications, unnoticed and undetected by Queensland authorities.

He was previously banned form any surgical practice in the United States and is suspected to have been involved in 87 deaths. I believe that the surveys are a good idea to ensure all the jurors are unbiased and make the best possible judgement.

For example, one of the jurors could vote against the Dr Patel because of racial factors. Jayant Patel, Dr. Death, is an ex-surgeon who is under trial for manslaughter after completing surgery, at Bundaberg Hospital, on Mervyn Morris June who died just 3 weeks later.

The jury for the case was chosen very strictly, 6 men and 6 women, who all had to complete a questionnaire about whether they were biased on race or colour and any opinions on the case.

After turning 9 potential jurors away, the final jury was chosen. The selection process took the whole day to complete. The trial will begin, in Brisbane, at 10am on Friday 8th February I think that it is reasonable for jurors to be dismissed if they have any pre-conceived opinions before they enter the courtroom because otherwise they would not just use what has been stated in the courtroom as evidence, they would also use what they have heard outside of the court which they have turned into their opinion and may be incorrect.

In this case, I think that a majority jury is better because Dr. Death has allegedly killed 3 people and left one permanently injured. Since he has disturbed so many lives, I think that if the majority vote guilty they are probably correct.

James Patel who was a former Bundaberg-based surgeon was convicted of man slaughter and was sentenced to seven years in jail. Real Christians believe what God has said. Since raw eggs are no longer considered safe, meringue powder now is used. Meringue pow der, made from dried egg white, is safe and can be reconstituted easily with a little water.

It is available at cake and candy supply stores. The other major change is that originally I used York Peppermint Patties, but over the years, vanilla wafers got smaller and I found the Peppermint Patties too large. Each tray should have the same number of wafers. In a small bowl, mix meringue powder and water. Start with the wafers facing up. Lightly brush each wafer with the meringue powder mixture.

Then sprinkle the top of each brushed wafer with sesame seeds and place wafer back on tray to dry. Repeat until all the wafers on the tray have been brushed with the meringue mixture and sprinkled with seeds. Set aside. In a second small bowl, mix the milk, almond extract, yellow and red food coloring.
